The Services are provided by Long Way Home, LLC, doing business as Out Driving ("Out Driving," "we," "us," or "our").

Please read these Terms carefully. By creating an account, enrolling in a course, or otherwise using the Services, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated here by reference. If you do not agree, do not use the Services.

Who We Are

Out Driving is a modern driver’s education, media, and automotive journal operated by Long Way Home, LLC. We provide self-paced online driver education while creating stories, ideas, and resources that inspire people to explore farther and experience more of the world with confidence.

Eligibility

You must be at least 13 years old to use the Services. If you are between 13 and 17 years old, you may use the Services only with the involvement, review, and consent of a parent or legal guardian, who agrees to be bound by these Terms on your behalf. By allowing a minor to use the Services, the parent or guardian represents that they have the authority to enter into these Terms on the minor's behalf and accepts responsibility for the minor's use of the Services. If you are using the Services on behalf of a minor, you agree to these Terms for both yourself and the minor.

Accounts and Registration

To access certain features, you must create an account. You agree to provide accurate, current, and complete information and to keep it up to date. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately of any unauthorized use. We may suspend or terminate accounts that contain false information or that are used in violation of these Terms.

The Services

Out Driving provides online driver education content, including lessons, quizzes, assessments, and, where applicable, a certificate of completion. The Services are provided for educational purposes. We do not administer driving license examinations, issue driver's licenses, or guarantee that you will pass any test or obtain any license or permit. Meeting the specific requirements of your state's licensing authority is your responsibility.

We may modify, update, add to, or discontinue parts of the Services at any time to improve them or to meet legal and regulatory requirements.

Fees, Billing, and Payment

Certain Services require payment. Prices are listed at the point of purchase and are stated in U.S. dollars. You agree to pay all applicable fees and taxes associated with your purchase. Payments are processed by our third-party payment processor [Stripe], and by making a purchase, you agree to their terms as well. You represent that you are authorized to use the payment method you provide. We may change our prices at any time, but changes will not affect courses you have already purchased.

Refunds and Cancellations

You may request a full refund within [7] days of purchase, provided you have not completed more than [25%] of the course and have not been issued a certificate of completion. After that period, or once a certificate has been issued, fees are non-refundable except where required by law. To request a refund, contact us using the details in the "Contact Us" section.

License to Use the Services

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for your own personal, non-commercial driver education. This license does not include any right to resell the Services, to reproduce or distribute course content, or to use the Services on behalf of any third party except a minor for whom you are the parent or guardian.

Acceptable Use

You agree not to:

  • Use the Services for any unlawful purpose or in violation of these Terms.

  • Share, sell, or transfer your account or course access to anyone else.

  • Have another person complete any portion of the course, quizzes, or assessments on your behalf, or otherwise misrepresent your identity or completion of the course.

  • Copy, record, reproduce, distribute, modify, or create derivative works from our content except as expressly permitted.

  • Attempt to gain unauthorized access to the Services, other accounts, or our systems, or interfere with or disrupt the Services.

  • Use any robot, scraper, or automated means to access the Services or collect information from them.

  • Upload or transmit malicious code or any content that is unlawful, harassing, or infringing.

We may investigate any violation and take appropriate action, including suspending or terminating access.

Intellectual Property

The Services and all content within them, including text, graphics, logos, images, video, audio, course materials, and software, are owned by Long Way Home, LLC or our licensors and are protected by intellectual property laws. The Out Driving name and logo and the Freedom in Progress name, logo, and related marks are trademarks of Long Way Home, LLC. Except for the limited license granted above, nothing in these Terms transfers any right, title, or interest in the Services or content to you.

User Content

If you submit content to us, such as reviews, testimonials, survey responses, photographs, moving images, audio, or other communications ("User Content"), you grant us a non-exclusive, worldwide, royalty-free, perpetual license to use, reproduce, display, and distribute that User Content in connection with the Services and our marketing. You represent that you own or have the necessary rights to the User Content you submit and that it does not violate the rights of any third party. We are not obligated to use or display any User Content and may remove it at our discretion.

Anything you submit or disclose or offer to us by or through this website, including e-mails to Out Driving or posting on interactive portions of this website, shall be deemed and shall remain the property of Long Way Home LLC. If you send us such materials or information, you are providing them to us on a NON-CONFIDENTIAL BASIS, and we will have no obligation to keep such materials or information secret, to refrain from using such materials or information, or to compensate you for the receipt or use of such. THIS PROVISION IS VOID, INAPPLICABLE OR UNENFORCEABLE IN THE STATE OF NEW JERSEY.

Third-Party Services and Links

The Services may integrate with or link to third-party services, resources, or websites, such as payment processors, analytics providers, and DMV or government resources. We do not control and are not responsible for third-party services or their content, and your use of them is subject to their own terms and policies. THIS PROVISION IS VOID, INAPPLICABLE OR UNENFORCEABLE IN THE STATE OF NEW JERSEY.

Course Completion, Certificates, and State Requirements

Where the Services offer a certificate of completion, the certificate reflects only that you completed our course. It does not by itself satisfy any state licensing requirement. Requirements for driver education, permits, and licenses vary by state and can change. You are solely responsible for confirming and satisfying the requirements of your state's licensing authority, including any accreditation, minimum-age, supervised-driving, or in-person testing requirements. We make no representation that our course is sponsored by any particular state or agency.

Long Way Home LLC controls and manages this website from its facilities in the State of Virginia, United States of America. We make no representation that such information, products, programs or services referenced on this website are legal, available or appropriate in your country or region. You and Long Way Home LLC waive any objection based on lack of personal jurisdiction, place of residence, improper venue or forum non convenient in any such action. THIS PROVISION IS VOID, INAPPLICABLE OR UNENFORCEABLE IN THE STATE OF NEW JERSEY.

Disputes 
PLEASE READ THIS SECTION CAREFULLY BECAUSE IT REQUIRES YOU TO ARBITRATE DISPUTES AND IT LIMITS THE MANNER IN WHICH YOU CAN SEEK RELIEF. Any dispute or claim relating in any way to these to the Terms of Use, this website, or any products or services sold or distributed by or through this website, will be resolved by binding arbitration, rather than in court, except that you may assert claims in small claims court if your claims qualify. The Federal Arbitration Act and federal arbitration law apply to the Terms of Use. We each agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated or representative action. If for any reason a claim proceeds in court rather than in arbitration we each waive any right to a jury trial. We also both agree that you or we may bring suit in court to enjoin infringement or other misuse of intellectual property rights. Termination

You may stop using the Services at any time. We may suspend or terminate your access to the Services at any time, with or without notice, if you violate these Terms or if we discontinue the Services. Upon termination, your right to use the Services ends. Sections of these Terms that by their nature should survive termination, including intellectual property, disclaimers, limitation of liability, indemnification, and dispute resolution, will survive.

Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the "Last Updated" date above and, where appropriate, provide additional notice. Changes are effective when posted. Your continued use of the Services after changes take effect means you accept the revised Terms.

By using the Services, you consent to receive communications from us electronically, including by email and by notices posted on the Site, and you agree that these electronic communications satisfy any legal requirement that a communication be in writing.

General

These Terms, together with our Privacy Policy and any additional terms you agree to, are the entire agreement between you and Out Driving regarding the Services. If any provision is found unenforceable, the remaining provisions will remain in effect. Our failure to enforce any provision is not a waiver of that provision. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets. We are not liable for any failure or delay in performance caused by events beyond our reasonable control.

Specific areas or pages of this website may include additional or different terms relating to the use of this website. In the event of a conflict between such terms and these terms of use such specific terms shall control.
