These Terms of Service ("Terms") govern your access to and use of www.outdriving.com (the "Site"), the Out Driving Journal, podcast, films, newsletter, social media accounts, and Gear store, and any related content or services we offer (collectively, the "Services"). The Services are provided by Out Driving, LLC ("Out Driving," "we," "us," or "our").
Please read these Terms carefully. By using the Services, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated here by reference. If you do not agree, do not use the Services.
Who We Are
Out Driving is a journal, podcast, and film series about the road, operated by Out Driving, LLC, a Virginia limited liability company. We share stories, guides, and conversations that help people drive with confidence and explore farther.
Eligibility
You must be at least 13 years old to use the Services. You must be at least 18 years old, or the age of majority where you live, to make a purchase from our Gear store.
About Our Content
Out Driving publishes stories, guides, reviews, podcast episodes, and films about driving and travel. Our content is general information shared for inspiration and education. It is not professional driving instruction, legal advice, or a substitute for your own judgment.
Traffic laws and road conditions vary by location and change over time. You are responsible for knowing and following the laws where you drive, for operating any vehicle safely, and for decisions you make based on our content. Never watch, read, or interact with our content while driving.
Our Milestones and other reviews reflect our own opinions and experiences at the time we visited or used something. Places, prices, hours, and products change, so please confirm details before you travel or buy.
Accounts and Subscriptions
Some features, such as our newsletter, ask for your email address. You agree to provide accurate information and to keep it current. You can unsubscribe from our emails at any time using the link in any message.
Gear Store
Orders and pricing. Prices are listed at checkout in U.S. dollars and do not include applicable taxes or shipping unless stated. We may change prices at any time, but changes will not affect orders already placed. We reserve the right to refuse or cancel any order, including orders affected by pricing or listing errors, and will refund any payment for a canceled order.
Payment. Payments are processed by our store platform and its third-party payment processors. By making a purchase, you agree to their terms as well, and you represent that you are authorized to use the payment method you provide.
Made to order. Many Out Driving products are made to order. Colors on screen may vary slightly from the finished product, and sizing may vary by style, so please check the size guide before ordering.
Shipping. Estimated production and delivery times are shown at checkout and are not guaranteed. Risk of loss passes to you when your order is delivered to the carrier.
Returns and exchanges. Because products are made to order, we do not accept returns or exchanges for change of mind or incorrect size selection. If your order arrives damaged, defective, or different from what you ordered, contact us within 30 days of delivery with your order number and a photo, and we will send a replacement or issue a refund.
License to Use the Services
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for your own personal, non-commercial use. This license does not include any right to resell the Services or to reproduce, distribute, or republish our content except as these Terms allow. You are welcome to share links to our articles, episodes, and films.
Acceptable Use
You agree not to:
Use the Services for any unlawful purpose or in violation of these Terms.
Copy, record, reproduce, distribute, modify, or create derivative works from our content, except for sharing links or brief quotes with credit to Out Driving.
Attempt to gain unauthorized access to the Services or our systems, or interfere with or disrupt the Services.
Use any robot, scraper, or automated means to access the Services or collect information from them, including to train artificial intelligence models, without our written permission.
Upload or transmit malicious code or any content that is unlawful, harassing, defamatory, or infringing.
Impersonate any person or misrepresent your affiliation with anyone.
We may investigate any violation and take appropriate action, including suspending or ending your access.
Intellectual Property
The Services and all content within them, including text, graphics, logos, photographs, video, audio, and software, are owned by Out Driving, LLC or our licensors and are protected by intellectual property laws. The Out Driving name and logo, the Milestone rating mark, and the Freedom in Progress name and related marks are trademarks of Out Driving, LLC. Except for the limited license above, nothing in these Terms transfers any right, title, or interest in the Services or our content to you.
Postcards and Content You Submit
When you send us a Postcard, story, question, comment, photo, video, or other material ("User Content"), including by email, through our contact form, or by tagging us on social media, you keep ownership of it. You grant us a non-exclusive, worldwide, royalty-free, perpetual license to use, reproduce, edit for length and clarity, display, perform, and distribute that User Content in connection with the Services, including reading it on the podcast, featuring it in the Journal, sharing it on social media, and using it in our marketing. We may credit you by first name and general location.
You represent that you own or have the rights to the User Content you submit, that it does not violate anyone else's rights, and that anyone who appears in it has agreed to its use. Submissions are not confidential, and we are not obligated to use, respond to, or compensate you for any User Content. We may decline or remove any User Content at our discretion. If you would like a submission kept private, tell us in your message.
Third-Party Services and Links
The Services may link to or embed third-party services, such as podcast platforms, YouTube, social media, maps, and the places and products we write about. We do not control and are not responsible for third-party services or their content, and your use of them is subject to their own terms and policies.
Disclaimers
THE SERVICES AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, OUT DRIVING, LLC DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT OUR CONTENT IS COMPLETE, CURRENT, OR ERROR-FREE, THAT THE SERVICES WILL BE UNINTERRUPTED OR SECURE, OR THAT DEFECTS WILL BE CORRECTED. YOUR USE OF THE SERVICES, AND ANY TRAVEL OR DRIVING YOU UNDERTAKE, IS AT YOUR OWN RISK. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES, SO SOME OF THESE EXCLUSIONS MAY NOT APPLY TO YOU.
Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, OUT DRIVING, LLC AND ITS OWNERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICES WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM OR ONE HUNDRED U.S. DOLLARS ($100). SOME JURISDICTIONS DO NOT ALLOW THESE LIMITATIONS, SO THEY MAY NOT APPLY TO YOU.
Indemnification
You agree to indemnify, defend, and hold harmless Out Driving, LLC and its owners, employees, and agents from any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or related to your use of the Services, your User Content, or your violation of these Terms, any law, or the rights of a third party.
Governing Law
These Terms are governed by the laws of the Commonwealth of Virginia and applicable federal law, without regard to conflict of law principles. The Services are operated from Virginia and intended for use in the United States. We make no representation that the Services or products are appropriate or available in other locations.
Dispute Resolution and Arbitration
PLEASE READ THIS SECTION CAREFULLY. IT REQUIRES YOU TO ARBITRATE DISPUTES AND LIMITS HOW YOU CAN SEEK RELIEF.
Talk to us first. Before starting any formal proceeding, you agree to contact us and give us 30 days to try to resolve the issue informally.
Binding arbitration. If we cannot resolve it informally, any dispute or claim relating in any way to these Terms, the Services, or any products sold through the Services will be resolved by binding individual arbitration rather than in court, except that either of us may bring a qualifying claim in small claims court. The Federal Arbitration Act governs this section. The arbitration will be administered by the American Arbitration Association under its Consumer Arbitration Rules, and will take place in Virginia or by video conference.
No class actions. You and we agree that any dispute will be resolved only on an individual basis and not in a class, consolidated, or representative action. If a claim proceeds in court rather than arbitration, we each waive any right to a jury trial.
Exceptions. Either of us may bring suit in court to stop infringement or misuse of intellectual property rights. Any such suit, and any claim not subject to arbitration, will be brought exclusively in the state or federal courts located in Virginia, and you and we consent to their jurisdiction.
Termination
You may stop using the Services at any time. We may suspend or end your access to the Services at any time, with or without notice, if you violate these Terms or if we discontinue the Services. Sections of these Terms that by their nature should survive, including intellectual property, User Content, disclaimers, limitation of liability, indemnification, and dispute resolution, will survive.
Changes to These Terms
We may update these Terms from time to time. When we do, we will revise the "Last Updated" date above and, where appropriate, provide additional notice. Changes are effective when posted. Your continued use of the Services after changes take effect means you accept the revised Terms.
Electronic Communications
By using the Services, you consent to receive communications from us electronically, including by email and by notices posted on the Site, and you agree that these communications satisfy any legal requirement that a communication be in writing.
New Jersey Residents
Nothing in these Terms is intended to limit any rights you may have under New Jersey law, including the Truth-in-Consumer Contract, Warranty and Notice Act. Any provision of these Terms that is void, unenforceable, or inapplicable under New Jersey law does not apply to New Jersey residents to the extent of that conflict.
General
These Terms, together with our Privacy Policy and any additional terms shown at checkout, are the entire agreement between you and Out Driving regarding the Services. If any provision is found unenforceable, the remaining provisions stay in effect. Our failure to enforce any provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets. We are not liable for any failure or delay caused by events beyond our reasonable control. If specific pages or features include additional terms, those terms control where they conflict with these.
